General terms and conditions of sale

Here is all the information relating to the General Terms and Conditions of Sale for www.albertipaolo.it. Read it carefully before purchasing. The Website is managed and maintained by Paolo Alberti. The offer and sale of products on our website is governed by these General Terms and Conditions of Sale in accordance with Articles 50 et seq. of Legislative Decree no. 206 dated 6 September 2005, the Consumer Code, Section II of Chapter I of Title Three of Part Three, which should be consulted as required by sec. 60 of the Consumer Code. 1. DEFINITIONS

1.1. "Site" is the www.albertipaolo.it website
1.2. "Customer” means any person who purchases an item on the Website, agreeing to the following General Terms and Conditions of Sale.
1.3. "Paolo Alberti" with head office in Via delle Marcelline 25 – 20063 Cernusco sul Naviglio (ITALY) TEL +39 (02) 92111841 – e-mail: shop@albertipaolo.it.
1.4. "Order" or "Order Form" is the form to request goods for sale, completed by the customer through the Website.
1.5. "Products" are the goods offered for sale on the Website, in accordance with the General Terms and Conditions of Sale.
1.6. "Price" is the price of the goods for sale.
1.7. "Contract" is the distance contract that relates to the sale of the products, according to the General Terms and Conditions of Sale.
1.8. "Parties" are Paolo Alberti and the Customer.

2. SUBJECT OF THE CONTRACT

2.1. With these General Terms and Conditions of Sale, Paolo Alberti sells and the Customer buys remotely the Products indicated and offered for sale on the website www.albertipaolo.it. The contract is exclusively concluded via internet when the Customer accesses www.albertipaolo.it and makes a purchase order in accordance with the procedure laid down by the website itself.
2.2. Product availability refers to those present at the moment in which the Customer consults the product information sheet; this must, however, be deemed solely indicative as, due to the possible simultaneous presence of multiple users on the website, the products may be sold to others before order confirmation.
2.3. Even after the order confirmation e-mail is sent by Paolo Alberti, there may be cases of partial or total unavailability of the goods. In this case, the Customer will be promptly informed and can decide whether to accept the delivery of only the products available or cancel the order by sending an e-mail to customer service.

3. CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

3.1. The sale will be deemed concluded when Paolo Alberti sends the Customer an order confirmation e-mail. The e-mail contains Customer and order information, the cost of the goods purchased, the cost of transport and the shipping address to which the goods will be sent.
3.2. By submitting the Order, the Customer confirms to know and accept the conditions of sale and the information contained in the website, also through links, including those relating to legal notes. The Customer undertakes to check the correctness of the data contained therein and to promptly communicate any corrections.
3.3. Paolo Alberti undertakes to describe and present the items sold on the website in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the website and the actual product may result due, for example, to the lighting in the photographs. In addition, the photographs of the products presented on the Website do not constitute part of the contract, as they are only representative.
3.4. Paolo Alberti undertakes to deliver the goods within 8 days from the day after payment by the Customer.

4. PRICES AND PRODUCT AVAILABILITY

4.1. The Products are offered for sale by Paolo Alberti according to the terms and conditions set out in the General Terms and Conditions of Sale posted on the Website at the time of the Order. Product Prices and Products are subject to change, with effect from the date of notice on the Website. The Customer accepts Paolo Alberti's right to change its prices at any time, however, the products will be invoiced at the price in effect at the time of the order and confirmed in the order acceptance confirmation e-mail sent by Paolo Alberti.
4.2 All product sale prices illustrated and indicated on the website are expressed in Euro and include VAT.
4.3. Shipping costs are not included in the purchase price, but are indicated and calculated at the end of the purchase process before making the payment.
4.4. Product availability refers to those present at the moment in which the Customer consults the product information sheet; this must, however, be deemed solely indicative as, due to the possible simultaneous presence of multiple users on the website, the products may be sold to others before order confirmation.
4.5. If the Products presented on our Website are unavailable at the time the Order is forwarded, Paolo Alberti will promptly notify the Customer regarding the unavailability of the products ordered and reimburse any amount already paid. The Customer has the right to cancel the order or accept delivery only of the products available at the prices indicated on the Website, notifying customer service via e-mail.


5.CUSTOMER OBLIGATIONS

5.1 To purchase any of our Products, the Customer must first register on the Website, providing all information required for order processing, shipment and delivery of the Products. Registration is free and in no way requires a purchase. The Customer undertakes to communicate current, accurate and complete information to Paolo Alberti: demographic information, personal details and any other useful Order processing information, data which will be processed in compliance with the provisions of Legislative Decree no. 196/2003 regarding "Personal data protection”.
5.2 The customer is responsible for paying the price of the Products purchased according to the methods set out in section 7 and shall keep a copy of the purchase order confirmation, sent by www.albertipaolo.it to the e-mail address provided by the customer during registration on the Website.

6. METHODS OF PAYMENT

6.1 All Payments made by the Customer occur solely by means of the credit cards listed on the Website.

If, following order registration and payment reservation on the credit card, the product is found to be unavailable, the payment operator will take the necessary steps to reverse the payment transaction related to the unavailable goods.

7. WITHDRAWAL

7.1. In accordance with applicable legal requirements, the Customer has the right to cancel purchases for any reason, without explanation and with no penalty, within 14 days (extended by Paolo Alberti from the 10 days provided by the law) from the date on which the products are received.
7.2. If the Customer chooses to exercise this right, he/she must contact customer service, via e-mail to shop@albertipaolo.it within 14 days after receiving the goods, after which Paolo Alberti will send the Customer authorisation for the return. The Products shall be returned by express courier with the option of tracing the shipment. Return costs shall be borne by the Customer. Shipment is under the full responsibility of the customer until receipt is confirmed by the Paolo Alberti warehouse;
Returned items must be shipped to Paolo Alberti, Via delle Marcelline, 25 – 20063 Cernusco Sul Naviglio (MI) ITALY within 7 working days from the date authorisation is received. Compliance with the 7 day period is assessed with reference to the time in which the Customer delivered the Products to be returned to the courier. In order for the right of withdrawal to be validly exercised, the Products purchased must be returned to the seller intact, not used or worn and in their original packaging, with the original labels unremoved. Products must be carefully packaged in order to protect the original packaging from any damage, writing or labelling. Returns shall not be accepted if not accompanied by the special return identification code.
7.3 Effectiveness of the withdrawal right is subject to the verification of the condition of the Products returned and their correspondence with those set out in the Order. Should the right of withdrawal be validly exercised pursuant to the previous provisions, Paolo Alberti will return the purchase price paid by the Customer, re-crediting the amount net of shipping fees and sales and transport charges, within 30 days maximum from the date the returned products are received.
In the event that products received do not conform to the order or are faulty, the Customer shall promptly notify Paolo Alberti via e-mail sent to shop@paoloalberti.it, within 7 days following the detection of the flaw. Prior to reimbursement, Paolo Alberti reserves the right to inspect the non-conformity claimed and, if confirmed, will ship replacement products or refund payment, re-crediting the credit card used by the customer for the purchase. By law, the charges for returning the goods are to be paid by the Customer.
Refunds will not include shipping costs, either those incurred in the original shipment of the goods or those for the subsequent return.
If there is no correspondence between the recipient of the Products indicated in the order form and the subject who made payment, in the event that the right of withdrawal is exercised, any amounts reimbursed will be returned to the subject making payment, releasing Paolo Alberti from liability.


8. LIABILITY

8.1 The parties will not be responsible for the delay in the fulfilment of their obligation, pursuant to the contract, if the delay is caused by circumstances beyond their reasonable control, even if resulting from a malfunction or disruption of the Internet, in the event that the order cannot be executed within the times stipulated by the contract.

9. COPYRIGHT AND BRAND NAMES

9.1 Brands, logos and any other distinguishing marks that are on the Website belong to their respective owners.
9.2 The use of brands, logos and any other distinguishing marks, including reproduction on other websites, is forbidden by unauthorised third parties.
9.3 Texts, design, animation files and images contained on the Website are protected by copyright.

10. PROTECTION AND PROCESSING OF PERSONAL DATA
10.1 Data communicated by the Customer necessary for the Contract are processed in compliance with the provisions of Legislative Decree 196/2003 regarding "Personal data protection". The Data Controller is Paolo Alberti.
10.2 Personal data requested during the forwarding of the order is collected and processed so as to satisfy the express requests of the Customer and will not, under any circumstances, be released to third parties.
10.3 The user is free to supply personal information through special sections of the Website and to apply for and request the transmission of informative material and other material.
10.4 The persons to whom personal data refer have (I) the right at all times to obtain confirmation as to existence or not of the data and to know their content and origin, to verify the accuracy of the data, request its integration, updating or correction, and (II) the right to request cancellation, transformation into anonymous form or the blockage of illegally processed data and to oppose, in any case, for legitimate reasons, their processing.

11. ENTIRETY

11.1 These General Terms and Conditions of Sale constitute the totality of the clauses that comprise it. If one or more stipulations of these General Terms and Conditions of Sale is deemed invalid or declared such pursuant to the law, regulations or following a decision by a court holding competent jurisdiction, the other provisions shall continue in full force and effect.


12. COMMUNICATION

12.1 All communication between the Parties shall be made in writing and forwarded to the address of the other party indicated in the contract and in the Order.
Communication sent via e-mail to the other party, indicated on the Website and the order, is also considered to be communication sent in writing.
12.2 Communication relating to the validity or existence of this contract, unless otherwise provided for, shall be exclusively delivered by hand or sent by registered letter with acknowledgement of receipt.

13. LANGUAGE, APPLICABLE LAW AND JURISDICTION

13.1 The Contract of sale is drawn up in Italian and in English. In case of any doubts or discordance, the Italian Version prevails. 13.2 The contract shall be governed by and construed in accordance with Italian law. 13.3 Any disputes arising from or connected with the Contracts of sale entered into pursuant to these General Terms and Conditions shall be taken to the Court of Milan.

14. AMENDMENTS

14.1 The General Terms and Conditions of Sale may undergo changes also due to new laws and regulations. The new General Terms and Conditions of Sale shall be effective as of the date of publication on the Website.

Shipments and payments

Delivery costs, as well as VAT and any other transfer taxes if due, shall be borne by the Customer and are clearly expressed in the Order phase. The Customer owes nothing more than the total amount of the Order shown at the end of the purchase procedure, with the exception of customs clearance for goods, which remain the sole responsibility of the Customer.

All orders are dispatched by a courier service to the shipping address indicated in the Order.

Shipping may be DDP or DDU depending on the Customer's nationality. DDP (Delivery Duty Paid) shipping is provided for EU Countries as better specified in the following section 8, and in this case VAT is already calculated and included in the purchase price; DDU (Delivery duty Unpaid) shipping is provided for non-EU Countries, and in this case not subject to VAT, but all local taxes and charges for importation and customs release are borne exclusively by the Customer.

Product delivery time is normally 2-4 working days from the date of payment, when in advance, or from the date the order is received, when payment is cod (cash on delivery). Delivery times are indicative and not binding for Paolo Alberti, which however, undertakes to execute the order within thirty (30) days from the aforementioned terms. Delivery times are intended as working days. Shipments are not made during holidays.

In the event of unavailability of one or more Products following the order, Paolo Alberti can ship the other Products ordered by the Customer. Partial delivery shall be considered valid and does not give the customer the right to refuse the delivery or demand compensation, except only the reimbursement of the Price paid for unavailable Products, pursuant to art. 3 section 7 of the General Terms and Conditions of Sale.

Paolo Alberti is released from the obligation to deliver the Products by transferring the obligation to the courier, pursuant to section 1510, paragraph 2, of the Italian Civil Code. The transfer of the Products to the carrier also constitutes identification pursuant to sec. 1378 of the Italian Civil Code, with the subsequent transfer of Product Property and the risk of its destruction to the Customer.
